Mississippi joins settlements with three more generic drug companies

AG Lynn Fitch

Mississippi Attorney General Lynn Fitch announced settlements with three additional generic drug companies as part of multistate litigation alleging that companies conspired to inflate prices and limit competition for numerous generic prescription drugs.

The latest settlements involve Ascend Laboratories, Citron Pharma and Mayne Pharma and have been submitted to the court for approval.

Under the agreements, Ascend will pay $400,000 and Mayne Pharma will pay $650,000. Citron Pharma has ceased business operations. All three companies also agreed to injunctive terms aimed at promoting competition and compliance with antitrust laws.

Fitch previously announced settlements with Sandoz, Glenmark, Lannett, Bausch, Apotex, Heritage and Heritage’s parent company, Emcure, totaling $496.5 million.

The litigation was brought by a coalition of 45 states and territories and alleges a widespread, long-running conspiracy to manipulate prices, reduce competition and restrain trade involving generic prescription drugs.

A multistate distribution plan is intended to return money from the settlements to people who may have paid elevated prices for certain generic medications.

According to the Attorney General’s Office, people who purchased a generic drug between May 2009 and December 2019 may be eligible for compensation.
