The man accused in the death of Ole Miss student Jimmie “Jay” Lee has petitioned the court for a change of venue.
Defense attorneys for Timothy Herrington say he won’t get a fair trial in Lafayette County because of the extensive media coverage of the case.

Herrington is charged with capital murder in Lee’s death. Lee had been missing for more than two years when his body was finally found in February of this year after Herrington’s first trial resulted in a hung jury.
The court has set his new trial for Oct. 13.
Lee’s body was found in Carroll County by people who were walking in the rural location where he was found. Herrington was arrested again shortly thereafter.
